Ethical Lemur is committed to protecting intellectual property (IP) rights and maintaining a fair and lawful online marketplace. This policy outlines our approach to IP rights, sets forth the responsibilities of our users, and explains the procedures we follow to address IP-related concerns.

Scope

This policy applies to all users of Ethical Lemur’s online marketplace, including buyers, sellers, and third-party service providers. It governs the listing, sale, and use of content, products, and services on our platform.

Our Commitment to Intellectual Property Rights

1. Respect for IP Rights:
   Ethical Lemur respects the intellectual property rights of all parties, including copyrights, trademarks, patents, and other proprietary rights.

2. Compliance with Laws:
   We comply with all relevant IP laws and regulations, including but not limited to the Digital Millennium Copyright Act (DMCA) and other applicable national and international laws.

User Responsibilities

1. Authenticity of Listings:
   All users must ensure that the products and content they upload, list, or sell on ethical-lemur.com do not infringe on the IP rights of others.

2. Prohibited Actions:
   Users are prohibited from:

   • Listing counterfeit, pirated, or unauthorised products.
   • Using copyrighted images, text, or other materials without proper authorisation.
   • Infringing on trademarks, patents, or design rights.

3. Grant of License:
   By uploading content to our platform, users grant Ethical Lemur a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content for the purposes of operating the marketplace.

Reporting Intellectual Property Violations

If you believe your IP rights have been infringed upon by a user of our platform, you can file a complaint through the following process:

1. Submit a Notice of Infringement:
   The notice must include:

   • A detailed description of the IP being infringed.
   • The specific listing(s) or content in question (with URLs or other identifying information).
   • Proof of your ownership or rights to the IP.
   • Your contact information (name, address, email, phone number).
   • A signed declaration that the information provided is accurate and made in good faith.

Our Response to IP Complaints

1. Review Process:

   • We will review all notices of infringement promptly.
   • If the notice is complete and valid, we may remove or disable access to the allegedly infringing content.

2. Notifying the Alleged Infringer:

   • The alleged infringer will be notified of the claim and provided an opportunity to respond with a counter-notice.

3. Counter-Notice Procedure:

   • If the alleged infringer believes their content is not infringing, they may submit a counter-notice that includes:
     • A detailed explanation of why the content is lawful.
     • Their contact information.
     • A signed declaration under penalty of perjury.

4. Restoring Content:
   If a valid counter-notice is received, we may restore the content unless the IP owner provides evidence of legal action within 10 business days.

Repeat Infringers

We maintain a zero-tolerance policy for repeat infringers. Users found to repeatedly violate this policy will have their accounts terminated.

Limitation of Liability

Ethical Lemur is a neutral intermediary and is not responsible for verifying the accuracy of IP ownership claims. While we take reasonable steps to address violations, we do not mediate disputes between users regarding intellectual property rights.

Policy Updates

This policy is reviewed regularly and updated to reflect changes in laws, regulations, or business practices. Users will be notified of significant updates via email or platform notifications.
